Judicial Matters


Today, President Obama nominated Elena Kagan to the Supreme Court.

Her resume includes dean of Harvard Law School--which means she raised money.

She is not a judge and, before the last year as Solicitor General, had never argued a case in appelate court. Her legal proficiency has been spotty and uneven.

Her most outstanding effort has been to throw military recruiters off of the Harvard University campus because she was opposed to President Clinton's "don't ask, don't tell" policy for the military. decrying it as a "moral injustice". Her amicus brief to the Supreme Court was rejected unanimously by the justices.
